Consultation Terms
Scope of services
Lavender River LLC provides consultative interior design guidance only. Services may include paint direction, finish coordination, mood boards, written plans, and other advisory deliverables. Services do not include construction, contracting, project oversight, purchasing, installation, scheduling, or supervision of trades. Lavender River does not act as the client's agent in any purchasing or contracting capacity.
Client responsibility
The client agrees that they are solely responsible for all final decisions related to their project, including but not limited to: verifying measurements, selecting and purchasing products, hiring and coordinating contractors and trades, scheduling installation, securing required permits, ensuring code compliance, and confirming suitability of recommended materials and finishes for their specific space and use case.
Communication and delivery
Consultations are delivered virtually via video conference, written summary, or visual deliverable as described in the specific service the client has purchased. Lavender River will make reasonable efforts to deliver services within the agreed-upon timeframe. Delivery timing may shift due to client responsiveness, intake completeness, or scheduling availability.
Intake, consent, and payment sequence
Before any payment is collected, the client must (1) complete the intake form, (2) review the Disclaimer, Refund Policy, and these Consultation Terms, (3) acknowledge the consent checkboxes, and (4) provide a typed signature. Only after these steps are complete will Lavender River send a payment link or invoice for the selected service.
Confidentiality
Lavender River will treat client project details, photos, and personal information as confidential and will not share them publicly without the client's prior written consent. Lavender River reserves the right to reference completed projects in general, anonymized terms (e.g., "a recent kitchen consult") for educational or marketing purposes.
Intellectual property
All mood boards, written plans, palettes, and other deliverables prepared by Lavender River are licensed to the client for personal use related to the project for which they were prepared. Resale, redistribution, or commercial use is not permitted without prior written consent.
Changes and additional work
Each service includes the deliverables described on the Services page. Significant changes in project scope, additional rooms, or expanded direction may require an additional service purchase. Lavender River will communicate any scope changes in writing before additional work begins.
Business hours and communication
Hours. Lavender River operates by appointment only. Office hours are Monday through Friday, 9:00 AM to 5:00 PM Eastern Time, and Saturday 10:00 AM to 2:00 PM Eastern Time. We are closed Sunday and on federal holidays.
Communication channels. Email to support@lavrivllc.com is the preferred channel for all client communication. Scheduled phone calls during business hours are available by appointment. Text messages are accepted during business hours only and will not be answered after 6:30 PM Eastern Time on any day.
Response time. We respond to email received during business hours within two (2) business days. Email received outside business hours is treated as received at 9:00 AM on the next business day.
After-hours fee. If a client contacts Lavender River outside business hours by any channel — phone, text, voicemail, DM, or email marked urgent — and we choose to respond, a flat after-hours response fee of $250 per communication applies, in addition to time billed at our then-current additional hour rate of $350 per hour (30-minute minimum). Lavender River is under no obligation to respond outside business hours and is not available for on-call or emergency support.
Contractor, vendor, and trade referrals — recommendation only, no agency
Lavender River may, from time to time, recommend or refer the client to independent contractors, tradespeople, vendors, suppliers, fabricators, painters, installers, or other third-party service providers (collectively, "Referred Providers"). All such referrals are made as a convenience to the client based on Lavender River's past experience or professional judgment. A Referred Provider does not work for Lavender River and is not an employee, agent, partner, subcontractor, or representative of Lavender River. Lavender River is only making a recommendation. If the client chooses to engage a Referred Provider, the client does so on the client's own accord and at the client's sole risk.
Separate contract required. The client and the Referred Provider must enter into their own separate written contract with each other, fully independent of any agreement the client has with Lavender River. That separate contract should cover pricing, scope of work, materials, deposits, payment terms, schedule, change orders, warranty, lien rights, and completion criteria. The client acknowledges that they are entering into that contract on their own and that the decision to engage the Referred Provider is solely the client's own.
The client acknowledges and agrees that:
- Any agreement, contract, scope of work, pricing, estimate, change order, payment terms, schedule, warranty, lien rights, insurance coverage, and performance is solely between the client and the Referred Provider.
- The client and the Referred Provider are responsible for working out any cost discrepancies, billing disputes, scope disagreements, change orders, schedule conflicts, unfinished work, punch-list items, quality concerns, or other disputes directly between themselves. Lavender River will not mediate, arbitrate, or intervene in any client–provider dispute.
- Lavender River is not a party to any contract between the client and any Referred Provider, does not negotiate on the client's behalf, does not approve estimates or invoices, and does not collect, hold, or disburse payments on the client's or the Referred Provider's behalf.
- Lavender River makes no representation, warranty, or guarantee — express or implied — as to the quality, licensure, insurance, bonding, workmanship, timeliness, pricing, or conduct of any Referred Provider.
- The client is solely responsible for independently vetting any Referred Provider, including verifying licensure, insurance, references, and reviews; obtaining and comparing written estimates; and entering into a written contract directly with the Referred Provider before any work begins.
- Lavender River shall have no liability for any loss, damage, delay, cost overrun, defect, injury, or dispute arising from work performed by, or products supplied by, any Referred Provider.
Project oversight is a separate, written engagement
Project oversight, construction administration, contractor coordination, site supervision, scheduling of trades, procurement, and on-site decision-making are not included in any consultation, mood board, paint direction, design report, or other advisory service offered by Lavender River. These activities are provided only under a separate, written Project Oversight Agreement signed by both Lavender River and the client and accompanied by a separate, agreed-upon fee.
Unless and until a written Project Oversight Agreement is executed, Lavender River acts solely as an advisory consultant and does not assume the role of project overseer, general contractor, owner's representative, or agent of the client. Any informal communication with a Referred Provider — including introductions, follow-up questions, or design clarifications — does not create a project oversight relationship or extend Lavender River's role beyond consultation.
Governing law
These terms are governed by the laws of the State of Maryland. Any dispute arising out of or related to services provided by Lavender River shall be brought in a court of competent jurisdiction in Maryland.
Acknowledgment
By signing the consent acknowledgment and completing payment, the client confirms they have read, understood, and agreed to these Consultation Terms, the Disclaimer, and the Refund Policy.
Client documents
The following templates are provided for review and reference. A signed copy of the applicable template is required before Lavender River begins any project oversight, scope change, final walkthrough, or photo/media use.
For clients
- Project Oversight Agreement (PDF) Required when Lavender River is engaged for project oversight beyond consultation. Defines scope, fees, add-on services, business hours, and no-solo-meetings rule.
- Change Order (PDF) Used to document any scope change, add-on hours, or expanded direction once a project is underway. Billed at $350/hour with a 30-minute minimum.
- Final Walkthrough Addendum (PDF) Required if Lavender River is asked to attend a final walkthrough with the client and contractor. $875 flat fee, up to 2 hours on site. No written summary is provided.
- Photo & Media Release (PDF) Client consent to use before-and-after photographs of the completed work for portfolio, marketing, and social media. Optional and revocable in writing.
For trade partners
- Trade Partner Agreement (PDF) Required of every contractor, tradesperson, fabricator, painter, installer, or vendor before Lavender River makes a client introduction. Defines the per-job referral fee, the follow-on client fee, the independent-relationship and no-agency provisions, and the dispute and indemnification terms.
